Agreement

These Terms of Service (“Terms”) govern access to and use of HushScrolls at https://hushscrolls.app and related mobile apps (the “Service”). The business name is HushScrolls. The Service is operated by Scott Savage trading as HushScrolls (“we”, “us”), ABN 87 606 341 996.

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service

HushScrolls provides AI-assisted generation of personalized children’s stories and related illustrations for personal, non-commercial family use. Features, quotas, and plans may change as we improve the product.

Eligibility

You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for all activity under your account and for keeping your credentials secure.

Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, abusive, or exploitative content involving children or anyone else
  • Send or process content you do not have the right to use (including photos of others without appropriate authority), including for optional create-from-photo analysis
  • Attempt to reverse engineer, abuse rate limits, or disrupt the Service
  • Resell or commercially redistribute generated stories or images without our written permission
  • Misrepresent your identity or affiliation with HushScrolls

We may suspend or terminate accounts that violate these Terms or that create risk for users, children, or the Service.

AI-generated content

Stories and images are generated with automated systems and may contain errors, inconsistencies, or unexpected material. You should review content before sharing it with children. The Service is not a substitute for parental judgment, education, or professional advice.

Subject to these Terms and applicable law, you may use stories generated for your account for personal family use. We retain rights needed to operate, improve, and secure the Service (including processing content through our providers).

Subscriptions and payments

Paid plans are billed through Stripe according to the plan you select. Fees, free tiers, and trial terms (if any) are shown in the app at purchase. Unless required by law, fees are non-refundable once a billing period has started. You can manage or cancel subscription renewals via the billing portal or by contacting hello@hushscrolls.app.

SMS and communications

If you provide a phone number, we may send one-time verification codes by SMS for account security. Message and data rates may apply. Essential service emails (e.g. password reset) may be sent to your account email.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the greater of (a) amounts you paid us for the Service in the 12 months before the claim or (b) AUD $50.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law or other applicable law.

Termination

You may stop using the Service at any time. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, and limitations) will survive termination.

Changes to the Terms

We may update these Terms by posting a revised version on this page with a new “Last updated” date. Continued use after changes constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of Australia (and the state or territory in which the operator resides), without regard to conflict of law rules. Courts there have exclusive jurisdiction, except where mandatory consumer protections require otherwise.
